1. Acceptance of Terms

By accessing or using our website and services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Any violation of these terms may result in immediate suspension, termination of services, and/or legal action.

  • Call-Based Campaigns 
  • Election Campaign Services
  • Industry-Specific Software
  • Database Segmentation & Filtering 
  • Value-Added Services, such as SMS-based Campaigns, Voice SMS Campaigns, Social Media Campaigns, and Call-Based Lead Generation.

 3. Legal Compliance 

  • Customers must comply with the Information Technology Act, 2000, Digital Personal Data Protection Act, 2023, and other applicable Indian laws.
  • All messaging and communication services must adhere to TRAI and DoT guidelines, including sender ID registration, content approval, and data privacy norms.
  • It is the customer’s responsibility to ensure that all campaigns comply with relevant laws and regulations.

4. Customer Obligations 

  • Provide accurate, complete, and verifiable information during registration and service requests.
  • Ensure all campaigns comply with legal requirements, avoiding spam, phishing, or unauthorized communication.
  • Maintain confidentiality of credentials provided for accessing services.

5. Prohibited Activities   Customers are strictly prohibited from:

  • Sending spam, phishing content, or unlawful messages.
  • Using services for fraudulent purposes, harassment, or violation of third-party rights.
  • Engaging in activities that disrupt or damage our platform or services.

6. Payment Terms  

  •   Payments must be made in advance unless explicitly agreed otherwise.
  •    Non-payment or payment disputes may result in suspension or termination of services.
  •    Any applicable taxes or fees will be borne by the customer. 

7. Service Delivery  

  • Intangible services are considered delivered once credentials, software licenses, or access details are provided to the customer. 
  • We are not responsible for delays caused by customer non-compliance, technical issues, or third-party platforms.

8. Termination of Services

We reserve the right to terminate services under the following circumstances: 

  • Violation of these T&C or applicable laws.
  • Misuse of services for illegal or unauthorized purposes.
  • Non-payment of dues. 

9. Liability Limitation  

  • We are not liable for damages arising from misuse of services, interruptions, or third-party failures. 
  • Customers use our platform and services at their own risk, and indemnify us from any claims arising from their use. 

10. Intellectual Property  

  • All content, trademarks, and materials on the platform are the exclusive property of BizSparrow or its licensors. 
  • Unauthorized use, reproduction, or distribution is prohibited. 

11. Data Privacy  

  • We adhere to the Digital Personal Data Protection Act, 2023 to safeguard customer information. 
  • Customer data will not be shared with third parties except as required by law or for service delivery.  

12. Dispute Resolution  

  • In case of disputes, customers agree to resolve matters amicably with us before pursuing legal remedies.  
  • Disputes will be subject to arbitration under the Arbitration and Conciliation Act, 1996, with the venue in Mumbai. 

13. Governing Law 

These T&C are governed by the laws of India. Any legal action or proceedings arising under these terms will be subject to the exclusive jurisdiction of the courts in Kota.  

14. Amendments to Terms  

We reserve the right to modify these T&C at any time. Customers will be notified of significant changes via email or platform notifications. Continued use of the platform constitutes acceptance of the updated terms.
